Smoking marijuana is illegal in China
Marijuana is illegal in China, and so is any related action. Cannabis is quite a big industry in China.
Although there have been some recent laws brought up to protect the city from its drug slingers, the world of a pot smoker is quite relaxed and relatively “legal” in the city of Beijing. Foreigners have usually left well alone, again, unless they do something stupid. In some foreign countries, marijuana does not belong to drugs, but marijuana belongs to drugs in China.
Article 32 of China’s Constitution stipulates that the People’s Republic of China protects the legitimate rights and interests of foreigners in China, and foreigners in China must abide by the laws of the People’s Republic of China
So as long as it is found out that foreigners use drugs in China, they should be judged according to Chinese laws and regulations.
Article 38 of the drug law of the People’s Republic of China stipulates that the public security organ of the people’s government at or above the county level shall make a decision on compulsory isolation and rehabilitation of drug addicts under any of the following circumstances:
- Refusing to accept community drug rehabilitation
- Taking or injecting narcotic drugs during the period of drug rehabilitation in the community
- Seriously violating the community drug treatment agreement
- Taking or injecting drugs again after the treatment of drug addiction in the community or compulsory isolation
It is illegal for foreigners to take drugs in China. They will be punished by administration, detained and fined. They may be forced to give up. As for whether they will be deported or not, it depends on the specific situation.
